👉રાષ્ટ્રીય શિક્ષણનીતિ-૨૦૨૦(New Education Policy-NEP) હેઠળના શિક્ષણ વિભાગના તા.૨૮/૦૪/૨૦૨૩ના ઠરાવ ક્રઃ-જશભ/૧૨૨૧/૫૦૩/ન મુજબ જે સરકારી પ્રા. શાળાઓમાં‘ બાલવાટિકા’ શરૂ કરવામાં આવે તે શાળાઓમાં મહેકમ નકકી કરતી વખતે ધો. ૧ થી ૫ માં અભ્યાસ કરતા કુલ વિદ્યાર્થીઓની સંખ્યામાં બાલવાટિકાના વિધાર્થીઓની સંખ્યા ઉમેરી ઉપરના કોષ્ટક મુજબ મહેકમ મંજૂર કરવાનું રહેશે. આ જોગવાઇ શૈક્ષણિક વર્ષ ૨૦૨૭-૨૮ કે બાલવાટિકા માટે અલગથી શિક્ષક નિમવાનો નિર્ણય ન થાય ત્યાં સુધી ચાલુ રહેશે.

રાજ્ય સરકારે ગત શૈક્ષણિક વર્ષથી 2020માં નોટિફિકેશન કરીને RTE એક્ટમાં સુધારારૂપે ધોરણ-1માં પ્રવેશ માટે 6 વર્ષનો નિયમ ફરજિયાત કર્યો છે. જો કે નિયમ જૂન 2023થી લાગુ થવાનો છે. વર્ષ 2020, 2021, 2022 અને 2022-23 એમ ત્રણ શૈક્ષણિક વર્ષ માટે આ નિયમનો અમલ થયો ન હતો અને 6 વર્ષ પુરા ન થયા હોય તેવા બાળકોને પણ ધોરણ 1માં પ્રવેશ અપાયો છે. હવે જૂન 2023થી આ નિયમ ફરજિયાત અમલી થવાનો છે.
રાજ્ય સરકાર દ્વારા કોઈ રાહત આપવાની કોઈ યોજના નછી પરંતુ વૈકલ્પિક વ્યવસ્થારૂપે રાજ્ય સરકાર ધોરણ 1 પહેલા બાલવાટિકાનો અભ્યાસ દાખલ કરવાની યોજના બનાવી રહી છે.
નવા નિયમથી અંદાજે 3 લાખથી વધુ બાળકોને અસર થશે. જેમને જુનિયર કેજી અને સિનિયર કેજી પુરુ કર્યા બાદ પણ 1લી જૂને છ વર્ષ પુરા ન થતા હોય કે 6 વર્ષમાં થોડા દિવસો બાકી હોય એવા મોટા પ્રમાણમાં વિદ્યાર્થીઓની સંખ્યા પણ મોટા પ્રમાણમાં છે.

Right of Children to Free and Compulsory Education Act, 2009.
No: GH/SH/04/PRE/122019/Single File-21/K:- In exercise of the powers conferred by sub-section (1) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), the Government of Gujarat hereby makes the following rules further to amend the Right of Children to Free and Compulsory Education Rules, 2012, namely;
1. (1) These rules may be called the Right of Children to Free and Compulsory Education (Amendment) Rules, 2020.
2. (2) They shall come into force on the date of their publication in the Official Gazette. In the Right of Children to Free and Compulsory Education Rules, 2012, in rule 3, for subrule(l), the following sub-rule shall be substituted, namely:
"(1) Admission of pupils : No Elementary School shall admit a child in 1t standard who has not completed 6th year of age on the 1“ June of the academic year:
Provided that for the.academic years 2020-2021, 2021-2022 and 2022-2023 a child shall be eligible for admission who has completed 5th year of age on the 1st June of the respective academic year."

The state education department has decided to increase the age limit for admission to class 1 from the new academic year starting from June-2023 to 6 years. Due to this decision, it is planned to start 'Balwatika' so that the students who are above 5 years but not completed 6 years are not deprived of admission. In the 'Balwatika' to be started in primary schools, such students above 5 years and below 6 years will be allotted admission. The students of 'Balwatika' will be taught only by teachers working in primary schools. Due to this, the concern of teachers being spared due to reduction in number due to age limit in St. 1 will be removed.
According to the state education department, education will be given in Balwatika only by the teachers working in 3 year primary schools, if even one day is missing, such students will not get admission in class 1. Protests started in the state against this decision and there were also representations that the students would lose a year. The circular was made earlier. In which it was decided to increase the age limit for admission to St. 1 to 6 years from the academic year 2023-24. So in the new academic year only students who complete 6 years on June 1 will be allotted admission in St. 1. Due to the age limit of 1st grade being 6 years, it would be difficult to get students in government primary schools. So, after investigating this, it was found that the number of students can be reduced by 50 percent due to the 6-year admission rule in the government primary schools. But the situation will not arise where the children will not be found at all. An average of 7 lakh children take admission in these schools every year.
